Welcome to Outburst Events!
These Terms and Conditions govern the agreement between Outburst Events (“the Company,” “we,” “us”) and the client (“the Client,” “you”) hiring our DJ, lighting, and sound services. By booking our services, you agree to comply with and be bound by the following terms.
1. Booking and Payments
- Deposit: A non-refundable deposit of $200 is required to secure the date of your event. No booking is confirmed until the deposit received upon the acceptance of the quote.
- Final Payment: The remaining balance must be paid in full 14 days prior to the event date. Failure to make payment may result in the cancellation of services without a refund of the deposit.
- Overtime: Any extension of performance time beyond the contracted hours is subject to the DJ’s availability and will be billed at our standard hourly overtime rate payable immediately.
2. Cancellations and Rescheduling
- Client Cancellation: If you cancel the event, the deposit remains non-refundable. Cancellations made less than 30 days before the event will require payment of the full contracted amount.
Rescheduling: We will make every effort to accommodate date changes, subject to our availability. A rescheduling fee may apply if changes are made close to the original event date. - Force Majeure: Neither party shall be liable for failure to perform duties due to Acts of God, severe weather, natural disasters, government restrictions, strikes, or other emergencies beyond reasonable control. In such cases, fees paid may be applied to a rescheduled date.
3. Equipment, Power, and Setup Requirements
- Technical Provisions: The Client is responsible for ensuring the venue provides adequate, safe, and stable electrical power.
- Setup Time: We require access to the venue prior to the start time for equipment setup and soundcheck, setup time depends on the scale of the event, this could vary and the same applies after the event for breakdown.
- Outdoor Events: For outdoor events, the Client must provide overhead shelter (such as a tent or canopy) to protect our electronic equipment, lighting, and media from direct sunlight, wind, heat, and rain. We reserve the right to cease operation if weather conditions threaten the safety of guests, staff, or equipment.
4. Damage and Liability
- Equipment Safety: The Client assumes full responsibility for any damage to or theft of our equipment (DJ decks, speakers, lights, microphones) caused by the Client, venue staff, or event guests. The Client will be billed for the repair or replacement cost of damaged gear.
- Crowd Safety: We maintain high-quality sound and lighting, including potential use of strobe effects and haze. It is the Client’s responsibility to notify guests with sensitivities (e.g., epilepsy).
- Liability Cap: Outburst Events’ maximum liability for any claim, breach, or damage shall not exceed the total monetary amount paid by the Client for the services.
2. Privacy Policy
At Outburst Events, we respect your privacy and are committed to protecting the personal data you share with us. This policy outlines how we collect, use, and safeguard your information.
1. Information We Collect
We collect information necessary to fulfil our event contracts, including:
- Contact Information: Name, email address, phone number, and billing/physical address.
- Event Details: Date, time, venue location, guest counts, and music preferences/playlists.
- Payment Information: Payment processing details (we do not store credit card numbers on our local servers; all payments are handled securely through third-party processors).
2. How We Use Your Information
We use your data strictly to:
- Deliver, coordinate, and customise our DJ, sound, and lighting services.
- Process invoices and payments.
- Communicate event logistics and updates.
- Comply with legal and tax obligations.
3. Data Sharing and Security
- No Third-Party Selling: We do not sell, rent, or trade your personal information to third parties.
- Service Providers: We may share necessary details with trusted third parties (such as secondary contractors or venue coordinators) solely to execute your event.
- Data Security: We implement industry-standard electronic and managerial safety measures to protect your data from unauthorised access or disclosure.
3. Use of Pictures and Videos (Media Release Policy)
To showcase our production quality, custom lighting setups, and crowd engagement, Outburst Events frequently captures media during events. By entering into an agreement with us, you agree to the following terms regarding media capture and usage:
1. Consent to Capture Media
- The Client grants Outburst Events and its authorised representatives the right to take photographs, audio recordings, and video footage during the setup, duration, and breakdown of the event. This includes footage of the DJ performance, lighting arrays, sound setups, and general crowd atmosphere.
2. Permitted Use of Media
You agree that Outburst Events owns the rights to these media assets and may use them for promotional, marketing, and commercial purposes, including but not limited to:
- The company website and digital portfolios.
- Social media platforms (Instagram, TikTok, YouTube, Facebook, etc.).
- Printed brochures, flyers, and advertising materials.
3. Privacy and Sensitivity Restrictions
- No Exploitation: We promise to use media tastefully. We will never intentionally publish photos or videos that portray the Client or their guests in an embarrassing, compromising, or derogatory manner.
- Anonymity Options: If your event is strictly private (e.g., high-profile corporate events, sensitive private parties) and you wish to opt-out of media capture, you must notify us in writing so we can include a “No-Media” clause in your quote .
- Third-Party Rights: If the Client hires a professional private photographer/videographer, the Client agrees to allow Outburst Events to request high-resolution images of our lighting and DJ setups from them, with appropriate credits given to the photographer.
